Darbo ir poilsio laikui keliami reikalavimai: ką reikia žinoti? Valstybinė darbo inspekcija primena, kad dirbant svarbu laikytis nustatytų darbo ir poilsio laiko reikalavimų. Maksimaliojo darbo laiko ir minimaliojo poilsio laiko nesilaikymas yra darbo įstatymų pažeidimas.
Darbuotojo darbo laiko norma pagal įstatymus
„Darbo laikas“ Darbo kodekse apibrėžiamas kaip bet koks laikas, kai darbuotojas yra darbdavio žinioje arba atlieka pareigas pagal darbo sutartį. Darbo laiko norma, kurią darbuotojas vidutiniškai per tam tikrą laikotarpį turi dirbti darbdaviui, kad atliktų pareigas pagal darbo sutartį (neskaitant papildomo darbo ir viršvalandžių), turi būti nustatyta darbo sutartyje ir ji gali būti nurodoma darbo valandomis per savaitę, darbo valandomis per dieną ar kt. apskaitinį laikotarpį, nepažeidžiant Darbo kodekso ar kt. darbo teisės normų nustatytų maksimaliojo darbo laiko ir minimaliojo poilsio laiko trukmės reikalavimų.
Darbuotojo darbo laiko norma yra 40 valandų per savaitę, nebent darbo teisės normos darbuotojui nustato sutrumpintą darbo laiko normą arba šalys susitaria dėl ne viso darbo laiko. Maksimaliojo darbo laiko reikalavimai (jeigu Darbo kodekso normos nenustato kitaip):
• vidutinis darbo laikas, įskaitant viršvalandžius, tačiau neįskaitant darbo pagal susitarimą dėl papildomo darbo, per kiekvieną septynių dienų laikotarpį negali būti ilgesnis kaip 48 val.;
• darbo laikas, įskaitant viršvalandžius ir darbą pagal susitarimą dėl papildomo darbo, per darbo dieną (pamainą) negali būti ilgesnis kaip 12 val., neįskaitant pietų pertraukos, ir 60 val. per kiekvieną septynių dienų laikotarpį;
• maksimalusis darbo laikas, dirbant pagal suminę darbo laiko apskaitą, įskaitant viršvalandžius, per kiekvieną septynių dienų laikotarpį, negali būti ilgesnis kaip 52 val., netaikant šios taisyklės darbui pagal susitarimą dėl papildomo darbo ir budėjimui;
• negali būti dirbama daugiau kaip šešias dienas per septynias paeiliui einančias dienas.
Darbo laiko režimo viršijimas ir viršvalandžiai
Kai darbuotojas faktiškai dirba viršydamas darbo laiko režimo jam nustatytą darbo dienos (pamainos) ar apskaitinio laikotarpio bendrą darbo laiko trukmę, nustatomi viršvalandžiai, kuriuos darbdavys gali nurodyti dirbti tik su darbuotojo sutikimu. Išimtis – atvejai, kai dirbami visuomenei būtini nenumatyti darbai arba siekiama užkirsti kelią nelaimėms, pavojams ir kt.; kai būtina užbaigti darbą arba pašalinti gedimą, dėl kurio didelis darbuotojų skaičius turėtų nutraukti darbą arba sugestų medžiagos, produktai ar įrenginiai; arba kai tai numatyta kolektyvinėje sutartyje.
Maksimali viršvalandžių trukmė – 8 val. per savaitę, darbuotojui sutikus – 12 val. per savaitę. Maksimali viršvalandžių trukmė per metus – 180 val.
Sutrumpintos darbo laiko normos ir apmokėjimo tvarka
Vyriausybė nustato sutrumpintas darbo laiko normas ir apmokėjimo tvarką asmenims, kurių darbo pobūdis yra susijęs su didesne protine, emocine įtampa, ir šių darbų, profesijų ir pareigybių sąrašą, ir sutrumpintas darbo laiko normas darbuotojams, dirbantiems darbo aplinkoje, kurioje įvertinus riziką nustatyta, kad sveikatai kenksmingų veiksnių dydžiai viršija darbuotojų saugos ir sveikatos teisės aktų leistinus dydžius (kiekius) ir jų kiekio darbo aplinkoje sumažinti iki sveikatai nekenksmingų dydžių neįmanoma.
Darbo kodekse taip pat numatyta sutrumpinta 32 val. per savaitę darbo laiko norma biudžetinių įstaigų darbuotojams, kurie augina vaikus iki 3 metų, už nedirbtą darbo laiko normos dalį jiems paliekant nustatytą darbo užmokestį. Ši sutrumpinta darbo laiko norma taikoma vienam iš tėvų (įtėvių) arba globėjų jų pasirinkimu, kol vaikui sukanka treji metai.
Minimaliojo poilsio laiko reikalavimai ir pietų pertrauka
Darbo kodekse, be darbo laiko, yra numatyti minimaliojo poilsio laiko reikalavimai. „Poilsio laikas“ Darbo kodekse apibrėžiamas kaip laisvas nuo darbo laikas. Kasdienio nepertraukiamojo poilsio tarp darbo dienų (pamainų) trukmė negali būti trumpesnė kaip 11 val. iš eilės, o per septynių paeiliui einančių dienų laikotarpį darbuotojui turi būti suteiktas bent 35 val. nepertraukiamojo poilsio laikas. Jeigu darbuotojo darbo dienos (pamainos) trukmė yra daugiau kaip 12 val., bet ne daugiau kaip 24 val., nepertraukiamojo poilsio tarp darbo dienų (pamainų) laikas negali būti mažesnis negu 24 val. Jeigu budėjimas trunka 24 val., poilsio laikas trunka ne mažiau kaip 24 val.
Kiekvienam darbuotojui turi būti suteikta pietų pertrauka ne vėliau kaip po 5 val. darbo ir jos trukmė negali būti trumpesnė negu 30 min. ir ne ilgesnė kaip 2 val., nebent šalys susitaria dėl suskaidytos darbo dienos laiko režimo.
Pertraukų trukmę, jų pradžią, pabaigą ir kitas sąlygas nustato darbo teisės normos ir darbo dienos (pamainų) grafikai. Atkreiptinas dėmesys, kad darbuotojams, atliekantiems darbus, kurių metu dėl gamybos sąlygų negalima daryti pertraukos pailsėti ir pavalgyti, turi būti suteikta galimybė pavalgyti darbo laiku ir šis laikas įskaitomas į darbo laiko trukmę.
Darbo kodeksas taip pat numato papildomų garantijų, susijusių su darbo ir poilsio laiku (pavyzdžiui, papildomas poilsio dienas, auginantiems vaikus; nemokamą laisvą laiką darbuotojo asmeniniams poreikiams tenkinti). Dėl darbuotojams palankesnių sąlygų galima tartis kolektyvinėje sutartyje.
