Nuo 2023 m. vasario 1 dienos darbdaviams įsigalioja didesnis delspinigių dydis – 0,1 procento už kiekvieną pradelstą dieną, kai neatsiskaitoma su darbuotoju, arba delspinigių norma didėja nuo 29,2 proc. iki 36,5 proc. metinių palūkanų. Iki šiol delspinigių dydis buvo 0,08 proc.
Tai aktualu darbuotojams, kai, darbo santykiams nepasibaigus, dėl darbdavio kaltės pavėluotai išmokamas darbo užmokestis ar kitos su darbo santykiais susijusios išmokos. Delspinigiai pradedami skaičiuoti nuo pirmos uždelsimo dienos iki pat atsiskaitymo dienos.
“Pagarba, atida ir teisėtų lūkesčių išpildymas darbuotojams – kiekvieno darbdavio pareiga. Darbuotojas – silpnoji teisinio ginčo pusė, todėl jį gina įstatymai. Jei darbdavys uždelsė atsiskaityti su darbuotoju, jis turi visas galimybes apsiginti Darbo ginčų komisijoje ir išsireikalauti ne tik delspinigius už nesumokamą atlygį, bet ir kreiptis į antstolius dėl jam priklausančios algos ar išmokos išieškojimo“, – sako socialinės apsaugos ir darbo ministerijos viceministras Vytautas Šilinskas.
Socialinės apsaugos ir darbo ministerija primena, kad, darbo užmokesčiui vėluojant daugiau kaip 2 mėnesius, darbuotojas savo iniciatyva, įspėjęs darbdavį ne vėliau kaip prieš 5 darbo dienas, gali nutraukti darbo santykius. Tokiu atveju darbuotojui priklausys jo 2 mėnesių vidutinio atlyginimo dydžio išeitinė išmoka, o jeigu darbo santykiai tęsėsi iki 1 metų, – 1 mėnesio darbuotojo vidutinio atlyginimo dydžio išmoka.
Jeigu ir nutraukus darbo sutartį darbdavys neatsiskaito su darbuotoju, skaičiuojami ne delspinigiai, o darbuotojo vidutinis darbo užmokestis už kiekvieną uždelstą dieną. Maksimalus laikotarpis – iki 6 mėnesių.
Kilus bet kokiems darbo ginčams – dėl laiku neišmokamo atlyginimo, pažeidžiant darbo laiko apskaitą ar kt., – darbuotojai gali kreiptis į Darbo ginčų komisiją. Skundas nagrinėjamas nemokamai, išnagrinėjamas per 1-2 mėnesius.
Per 2022 metus Darbo ginčų komisija priteisė 7,9 mln. Eur darbuotojų naudai. Sprendimą dėl priteisimo galima perduoti antstoliui, kuris areštuos darbdavio sąskaitas ir perves darbuotojui priteistas sumas.
Delspinigiai neskaičiuojami, jeigu darbdaviui pradėtos bankroto procedūros. Tokiu atveju darbuotojas gali kreiptis į Garantinį fondą ir jam bus išmokama jo kreditorinio reikalavimo suma, bet ne didesnė nei 6 minimaliųjų mėnesinių algų (MMA) dydžio, t. y. iki 5040 Eur 2023 m. Lėšos iš Garantinio fondo skiriamos tik tada, kai darbdavys tampa nemokus ir neturi pakankamai nuosavų lėšų atsiskaityti su darbuotojais.
