Įgyvendindama Europos Komisijos deleguotąją direktyvą, Sveikatos apsaugos ministerija parengė Tabako, tabako gaminių ir su jais susijusių gaminių įstatymo pataisas, kuriomis naikinamos išimtys, taikomos kaitinamojo tabako gaminiams. Jeigu šioms pataisoms pritars Seimas, minėti gaminiai negalės sudėtyje turėti kvapiųjų medžiagų ir turės būti ženklinami pagal naujus reikalavimus.
Europos Komisijos deleguotoji direktyva įpareigoja šalis nares nacionalinių teisės aktų pakeitimus priimti iki 2023 m. liepos 23 d., o nuo 2023 m. spalio 23 d. – pradėti juos taikyti. Vyriausybė trečiadienį pritarė pataisoms, toliau jos bus teikiamos Seimui.
Pakeitimais siekiama uždrausti tiekti į Lietuvos rinką pridėtinio kvapo ar skonio kaitinamojo tabako gaminius. Taip pat kaitinamojo tabako gaminiams, jei jie yra rūkomojo tabako gaminiai (vartojami pridegti), siūloma taikyti griežtesnius ženklinimo reikalavimus, numatytus Tabako, tabako gaminių ir su jais susijusių gaminių įstatyme.
Įstatymas numato, kad kaitinamojo tabako gaminiai, kurie vartojami pridegti, turi būti ženklinami tekstiniais ir vaizdiniais įspėjimais, numatytais Įstatymo 81–83 straipsniuose, o bedūmiai kaitinamojo tabako gaminiai (vartojami nepridegti) – tekstiniu įspėjimu, numatytu Įstatymo 85 straipsnyje. Šis reikalavimas bedūmiams kaitinamojo tabako gaminiams galiojo ir iki šiol.
Tyrimai rodo, kad kaitinamojo tabako gaminių vartojimas Lietuvoje auga. 2020 m. atlikto Eurobarometro tyrimo „Europos gyventojų požiūris į tabaką ir elektronines cigaretes“ duomenimis, kaitinamojo tabako vartojimo paplitimas Lietuvoje viršija ES vidurkį. Kaitinamo tabako gaminius bent kartą gyvenime bandė 10 proc. apklaustųjų (16 vyrų ir 6 proc. moterų), ES vidurkis – 6 proc.
Pagal Narkotikų, tabako ir alkoholio kontrolės departamento 2021 m. atlikto Psichoaktyviųjų medžiagų vartojimo paplitimo populiacijoje tyrimo duomenis, kaitinamuosius tabako gaminius bent kartą gyvenime buvo išbandę 17,9 proc. 15–64 m. amžiaus Lietuvos gyventojų. Kaitinamųjų tabako gaminių vartojimo paplitimas buvo didesnis tarp vyrų nei moterų, taip pat tarp 15–34 m. amžiaus gyventojų (32,2 proc.).
Lietuvos sveikatos mokslų universiteto 2022 m. atlikto „Lietuvos gyventojų elektroninių cigarečių ir kaitinamojo tabako gaminių vartojimo paplitimo ir įpročių tyrimo“ rezultatai parodė, kad pagrindiniai veiksniai, nulėmę pasirinkimą pradėti vartoti elektronines cigaretes arba kaitinamojo tabako gaminius, buvo draugų, kolegų ar kitų asmenų, kurie rūkė naujoviškus bedūmius kaitinamojo tabako gaminius, pavyzdys (30,6 proc.) ir galimybė įsigyti įvairių skonių ir kvapų gaminius (28,3 proc.). Tiek tarp elektroninių cigarečių, tiek tarp kaitinamojo tabako gaminių vartotojų populiariausi buvo skonį ir kvapą turintys gaminiai.
Tikimasi, kad Europos Komisijos deleguotosios direktyvos taikymas Europos Sąjungos lygiu leis mažinti kaitinamojo tabako gaminių patrauklumą ir vartojimo paplitimą, ypač tarp jaunų asmenų.
