Skolų turintys bedarbiai, pradėję dirbti, galės pasinaudoti vadinamosiomis „skolų atostogomis“, tai yra laikinai sustabdyti išieškojimą, o išskaitos iš atlyginimo bus mažesnės nei iki šiol, taip skatinant žmones dirbti legaliai. Be to, numatyta griežtesnė nelegalaus darbo kontrolė ir didesnės baudos už pažeidimus. Tokioms Socialinės apsaugos ir darbo ministerijos (SADM) parengtoms pataisoms šiandien pritarta Seime.
Numatyta, jog „skolų atostogomis“ bus galima pasinaudoti nuo gruodžio 1 d., kitos naujovės įsigalios dar liepą.
Socialinės apsaugos ir darbo ministrės Monikos Navickienės teigimu, šie pakeitimai, kai skolų turintieji bus labiau suinteresuoti dirbti legaliai, o gresianti žymiai didesnė atsakomybė veiks kaip atgrasymo mechanizmas darbdaviams, leis mažinti šešėlinio darbo mastą.
„Tikslas – kad skolininkai dirbtų, užsidirbtų ir grąžintų skolas. Duomenys rodo, kad ne vieną skolų turintį žmogų dirbti legaliai demotyvuoja išskaitos, todėl neretas darbdavys išgirsta prašymus įdarbinti „šešėlyje“. Siekiame, kad piktnaudžiavimo mažėtų, o skolininkai būtų skatinami grįžti į legalią darbo rinką“, – teigia M. Navickienė.
Skaičiuojama, kad, jei bent 1 proc. skolininkų (t. y. apie 2 tūkst. žmonių) pradėtų dirbti už 1 minimalią mėnesinę algą (MMA), tai leistų surinkti apie 6,5 mln. eurų mokesčių ir įmokų kasmet, tačiau netiesioginė nauda būtų dar didesnė – sumažėtų socialinė parama, didėtų darbu sukuriama nauda.
Numatyta, kad skolų turintieji bedarbiai, registruoti Užimtumo tarnyboje ir pradėję dirbti, galės pasinaudoti galimybe išeiti 6 mėnesių „skolų atostogų“, t. y. bedarbiui, turinčiam skolų, įsidarbinus, Užimtumo tarnyba perduos duomenis apie asmens įsidarbinimą antstoliams, o asmuo galės pateikti prašymą antstoliui dėl išieškojimų sustabdymo. „Skolų atostogomis“ iš viso bus galima pasinaudoti ne daugiau kaip 2 kartus per 5 metus.
Taip pat sumažintos išskaitos iš atlyginimo. Dabar dirbančiam skolininkui lieka mažiau nei 15 eurų per dieną, įsigaliojus pakeitimams – ši suma išaugs. Numatyta, kad uždirbantiems iki 1 MMA išskaita sumažės iki 10 proc. atlyginimo dydžio (vietoj dabar esančių 20 proc. arba 30 proc.), uždirbantiems tarp 1 MMA ir 2 MMA – 30 proc., uždirbantiems virš 2 MMA – 50 proc. (vietoj išskaitymo iš dalies virš MMA).
Svarbu tai, kad iki šiol galiojanti išskaitų išieškojimo tvarka ir toliau liks nepakitusi socialiai jautriems kreditoriams – vaikų ir kitų asmenų išlaikymui, žalos, padarytos sveikatai ar gyvybei, atlyginimui.
Be to, pakeitimais skolininkui bus suteikiama galimybė neprarasti itin mažos vertės paskutinio būsto. Pagal šiuo metu galiojančią tvarką, 4 tūkst. eurų skolos neišieškojus per 18 mėnesių, skola gali būti išieškoma iš skolininko paskutinio būsto. Įsigaliojus pakeitimams, ši suma bus indeksuota ir padidinta iki daugiau nei 9 tūkst. eurų (10 MMA), dvigubai – nuo 18 iki 36 mėnesių – prailginta ir papildoma apsauga – terminas, per kurį skolininkas, įrodęs, kad susimokės, paskutinio būsto neprarastų.
Taip pat už nelegalų darbą numatytos 3 kartus didesnės baudos, sieksiančios nuo 3 (2 772 Eur) iki 12 (11 088 Eur) MMA, o už pakartotinį pažeidimą – nuo 6 (5 544 Eur) iki 24 (22 176 Eur) MMA.
Be to, Valstybinė darbo inspekcija savo interneto svetainėje viešins darbdavius, pažeidusius darbo įstatymus, darbuotojų saugos ir sveikatos, nelaimingų atsitikimų darbe teisės aktus. Tokiu būdu bus vykdoma šių pažeidimų prevencija bei apie rizikingą darbovietę informuojami darbuotojai ir siekiantys įsidarbinti asmenys.
Duomenys rodo, kad Lietuvoje yra apie 200 tūkst. žmonių, kurie turi skolų. Tai beveik kas dešimtas asmuo nuo 18 metų. Iš jų beveik 7 iš 10 nedirba arba dirba nelegaliai.
