Nuotr. Artūro Žuko Vyriausybė pritarė Švietimo, mokslo ir sporto ministerijos parengtiems Švietimo bei Profesinio mokymo įstatymų pakeitimų projektams ir teiks juos Seimui. Įstatymų pakeitimais nustatyti mokyklų veiklos kriterijai, šiuo metu reglamentuojami Vyriausybės nutarimu.
Švietimo, mokslo ir sporto ministerijos parengtame projekte Švietimo įstatymas papildytas kriterijais, kuriuos turi atitikti mokyklos, vykdančios bendrojo ugdymo programas. Kaip ir iki šiol, mokyklos ugdymo planas turės atitikti švietimo, mokslo ir sporto ministro patvirtintus bendruosius ugdymo planus, mokymosi aplinka ir mokinių krūvis – higienos normas ir teisės aktų nustatytus mokinių saugos bei sveikatos reikalavimus, o mokyklos vadovų, mokytojų ir švietimo pagalbos specialistų turimas išsilavinimas ir kvalifikacija – įstatymo ir švietimo, mokslo ir sporto ministro nustatytus reikalavimus.
Ugdymo fizinė ir informacinė aplinka turi būti pritaikyta mokiniams, turintiems specialiųjų ugdymosi poreikių. Užtikrinamas mokymosi ir švietimo pagalbos teikimas pagal švietimo, mokslo ir sporto ministro nustatytas tvarkas.
Kaip ir iki šiol, mokinių skaičius valstybinės ir savivaldybės mokyklos klasėse turės atitikti leistiną mažiausią ir (arba) didžiausią mokinių skaičių, kurį nustato Vyriausybė, atsižvelgdama į bendrojo ugdymo programos lygmenį, mokinių ugdymosi poreikių tenkinimą, mokinių specialiuosius ugdymosi poreikius, Vyriausybės nustatytus klasių jungimo principus bei siekdama ugdymo kokybės, valstybės ir savivaldybių biudžetų lėšų naudojimo ekonomiškumo, efektyvumo ir rezultatyvumo.
Įstatymų pakeitimai parengti vykdant balandžio 26 d. priimtą Konstitucinio Teismo sprendimą, kuris įpareigojo mokyklų veiklos kriterijus reglamentuoti Švietimo įstatyme.
Pagal Konstitucinio Teismo nutarimą, Seimas iki 2024 m. sausio 2 d. turi įtvirtinti aiškius mokyklų veiklos kriterijus, o Vyriausybė – įstatymu leidžiamose ribose priimti poįstatyminius teisės aktus, kuriais, kaip yra konstatavęs Konstitucinis Teismas, galės būti detalizuojamos ir sukonkretinamos įstatymo normos, reglamentuojamas jų įgyvendinimas.
